These general terms and conditions apply to all services offered by Lux Destina. Lux Destina acts as an intermediary and travel curator, providing tailor-made luxury travel experiences without being a direct service provider. By using our services, the customer agrees to the following terms.
Article 1: Definitions
1.1. Lux Destina: The high-end travel organization that designs and mediates tailor-made luxury trips.
1.2. Customer: The person or entity booking a trip through Lux Destina.
1.3. Service Providers: Hotels, airlines, transport companies, and other partners Lux Destina collaborates with.
1.4. Force Majeure: Unforeseen circumstances such as natural disasters, political unrest, strikes, or other events beyond the control of Lux Destina and its partners.
Article 2: Applicability
2.1. These terms apply to all services offered by Lux Destina.
2.2. Lux Destina solely acts as an intermediary and is not a direct provider of travel services.
2.3. By placing a booking, the customer agrees to these terms and conditions.
Article 3: Reservations and Payments
3.1. A reservation is only final upon receipt of a written confirmation.
3.2. The customer must pay a deposit of at least 50% at the time of booking.
3.3. The remaining balance must be paid no later than 30 days before departure.
3.4. If payment is not received on time, Lux Destina reserves the right to cancel the booking without refunding the deposit.
Article 4: Cancellation Policy
4.1. Cancellation by the customer
If the customer wishes to cancel the trip, Lux Destina is not obligated to refund any payments already made. Lux Destina acts solely as an intermediary, and all bookings are subject to the cancellation terms of the individual service providers (e.g., hotels, airlines).
Refunds will only be issued if, and to the extent that, the relevant service provider permits cancellation under their own terms.
4.2. Cancellation by Lux Destina
In the event of force majeure or circumstances beyond the control of Lux Destina, the company will propose an alternative travel arrangement or issue a credit voucher valid for future bookings. If no suitable alternative is available, the customer will receive a refund minus administrative costs, provided that Lux Destina is able to recover the amounts from the service providers.
4.3. Changes to bookings
Changes to confirmed bookings (e.g., dates, names, destination) are subject to availability and may incur additional costs. Lux Destina applies an administrative fee of €50 per change, in addition to any fees charged by service providers.
Article 5: Liability
5.1. Lux Destina is not liable for the execution of services provided by third parties (hotels, airlines, etc.).
5.2. Any complaints about the trip must be reported directly to the service provider on-site.
5.3. Lux Destina is not responsible for delays, cancellations, lost luggage, or other incidents caused by external parties.
Article 6: Transferability of Bookings
6.1. The customer may transfer their booking to a third party, provided this is reported in writing at least 14 days before departure to Lux Destina.
6.2. Any additional costs associated with name changes or transfers are the responsibility of the original customer.
Article 7: Dispute Resolution
7.1. Complaints must be submitted in writing within 7 days after the trip.
7.2. In case of a dispute, an amicable settlement will first be attempted.
7.3. If no resolution is found, the customer may refer to the Travel Disputes Committee or a competent court.
Article 8: Privacy and Data Protection
8.1. Lux Destina processes personal data solely for booking and communication purposes.
8.2. All data is processed in accordance with GDPR regulations.
Article 9: Force Majeure
9.1. Lux Destina is not responsible for damages or inconveniences caused by force majeure.
9.2. In such cases, Lux Destina will make every effort to provide a suitable alternative.
Article 10: Final Provisions
10.1. Lux Destina reserves the right to amend these terms at any time.
10.2. The most recent version is always available on the official Lux Destina website.
Article 11: Transport Mediation and Liability
11.1. Lux Destina solely acts as an intermediary for transport services, including but not limited to airport transfers, private chauffeurs, luxury car rentals, and commercial airline tickets.
11.2. The actual execution of the transport is entirely the responsibility of the respective transport provider. Lux Destina is not liable for delays, cancellations, lost luggage, damages, or other incidents occurring during transport.
11.3. Customers are bound by the general terms and conditions of the carrier, which apply to the booked service. Complaints must be directed to the executing party.
11.4. If a transport service is not executed as agreed, Lux Destina will make efforts to arrange a suitable alternative but is not obligated to provide refunds or compensations beyond the carrier’s conditions.
Article 12 Cancellations & Modifications
12.1. Cancellation by the client
In the event that the client cancels the trip for any reason, Lux Destina is under no obligation to refund any amounts already paid. Lux Destina acts solely as an intermediary between the client and third-party service providers (such as airlines, hotels, and local partners). Refunds are only possible if, and to the extent that, the respective provider agrees to do so.
12.2. Non-refundable services
Certain services – including but not limited to flight tickets, hotel reservations, and transfers – may be subject to non-refundable conditions as defined by the supplier. In the event of a cancellation, these costs remain the responsibility of the client.
12.3. Cancellation insurance
Lux Destina strongly advises all clients to obtain cancellation and travel insurance from a recognised insurer prior to confirming the trip. This insurance may offer financial protection in case of unforeseen circumstances such as illness, family emergencies, or travel disruptions.
12.4. Changes requested by the client
Any change to the travel arrangement (including dates, participants, or destination) requested by the client is subject to availability and potential extra costs. Lux Destina applies a €50 administrative fee per change, excluding any additional costs charged by third-party providers.
12.5. Changes initiated by Lux Destina or partners
In exceptional cases, changes to the travel itinerary may be necessary due to force majeure, availability issues, or safety concerns. In such cases, Lux Destina will make every effort to provide a comparable alternative. These changes do not entitle the client to compensation unless required by applicable law.
